Job Description

Protecnium is an international consulting firm specializing in engineering and technical services (). We are currently looking for a  Commercial Manager  to join our team for a  Bridge Construction Project  in  Philadelphia Pennsylvania.

-Location:  Philadelphia Pennsylvania.

-Project : Bridge Project

-Estimated duration of the position:  2 years - In general, when the project ends, we try to place the employee in other projects to give him/her continuity.

-Summary:   The Commercial Manager shall manage and oversee all contract-management.

This position will oversee the contract management team and coordinate the with the project team on matters necessary for maintaining planning and coordinating commercial aspects along with compliance with all relative contracts, customer requirements, and applicable law.

-Responsibilities:

- Actively identify commercial and contractual risks and mitigation strategies.

-Support the project team and oversee compliance with prime contracts and subcontracts.

-Evaluate and negotiate various design and construction contracts.

-Develop strategies to resolve internal and external contract issues.

-Implement and ensure compliance with strategic commercial approaches.

-Develop and apply contract management policies, procedures, and systems.

-Provide contractual clarifications and coordinate with JV partners and external legal counsel.

-Protect company interests in all contractual and commercial matters.

-Identify and report subcontractor contractual issues, enforcing obligations and rights per agreements.

-Manage changes and claims with PennDOT and subcontractors, assessing cause, effect, entitlement, cost, and time.

-Support preparation and management of notices, change requests, claims, and disputes per contract terms.

-Assist in negotiating and managing change orders to maximize returns and minimize risks.

-Develop strategies to prevent, mitigate, or transfer contractual and commercial risks.

-Monitor contracts for close-out, retention, extension, or renewal to benefit the Joint Venture.

-Manage project commercial and contracting risks, including insurance requirements and securities.

-Prepare and review contractual correspondence for assigned subcontracts.

-Produce monthly internal and external reports on contractual and commercial matters.

-Maintain logs and records of contracts, changes, claims, risks, and opportunities.

-Interface regularly with clients, departments, and the public on contract and purchasing matters.

-Administer bidding processes and contracts, evaluating bids and recommending vendors.

-Ensure vendor and contract compliance with state and federal regulations.

-Identify cost-saving opportunities and ensure compliance with Joint Venture policies.

-Support Procurement with contract terms and conditions as needed.

-Keep Project Management and Executive Committee informed of contractual issues.

-Perform other duties as assigned by the direct supervisor.

-Requirements:

  • A minimum of 8 years of work experience in a contract management role within the construction industry. Experience as a Commercial Manager in bridge/highway/ heavy civil construction projects or similar.
  • Bachelor's degree in Business, Engineering, Construction Management, Law or related degree. MBA or JD degree preferred.
  • Advanced knowledge of construction contract administration and the principles of purchasing, finance and estimating.
  • Experience working within a P3 and/or Design-Build Environment would be preferred.
  • Thorough knowledge of contract

-Working hours:  Monday to Friday, 40 hours weekly.
